Terms and Conditions

These Terms and Conditions (“Agreement”) govern the services provided by Envictus Digital Landscaping (“Envictus,” “we,” “our,” or “us”) to the client (“you” or “your”). By engaging our services, you agree to the following terms:

1. Consultation Calls

We require a $35.00 fee for initial consultation calls, which helps ensure that our time and expertise are reserved for clients who are serious about building their digital presence. Consultation calls allow us to assess your goals, answer questions, and provide tailored recommendations that set your project up for success.

Consultation call payments are non-refundable.

Payment must be received in full prior to the scheduled call; invoices will not be issued for consultation fees.

Calls must be scheduled within two weeks of payment.

Consultation calls are limited to one hour in length.

If you choose to proceed with Envictus services after your consultation, the cost of the call will be credited toward your overall project fee.

2. Payments

All projects require payments in two installments:

Deposit: A deposit is required before any work begins following the consultation call. This deposit is non-refundable, as it secures your place in our workflow and covers the time and resources already invested into project discovery and planning.

Final Payment: The remaining balance is due prior to the launch of your website. No exceptions will be made.

By submitting payment, you acknowledge and agree to these conditions.

3. Design Process

Our design process is structured to ensure clarity, efficiency, and collaboration:

Discovery: We identify your goals, target audience, and brand vision, laying the foundation for your website’s purpose. Deposits must be received before this stage begins.

Kick Off: We establish a project plan, timeline, and deliverables to ensure alignment and a smooth workflow.

Building: We create the site architecture and design, integrating mockups, visuals, and functionality. This is where coding and implementation begin.

Launch: Your site undergoes testing, adjustments, and quality checks before going live. Final payment must be received before this stage is completed.

Revisions

Clients are entitled to a maximum of three revision rounds. Revisions must be made prior to the Building stage, during the mockup review process. Once development begins, structural coding is in place and major revisions cannot be accommodated without additional costs. Clients are encouraged to provide clear feedback during the mockup phase to ensure their vision is captured.

4. Images & Media

Envictus provides access to royalty-free stock images from trusted sources, which ensures your website benefits from professional, high-quality visuals without copyright concerns.

Clients may also provide their own images. However, Envictus assumes no legal responsibility for client-supplied images. By submitting images, you confirm that you own the rights to use them or have obtained proper permissions. Envictus will not be liable for any copyright disputes arising from materials provided by clients.

5. Services & Deliverables

Envictus provides the following deliverables as part of our services:

Wireframes to establish site structure and layout.

Mockups that visualize the design and allow for client feedback.

A final, fully functional website built on the agreed-upon platform.

Clients must approve mockups before development begins. Once mockups are finalized, coding (including HTML, CSS, and platform-specific integration) will be applied. Any major design changes requested after this stage will be subject to additional fees.

6. Project Timeline

Project timelines vary depending on scope and complexity. A timeline will be outlined during the Kick Off stage. Delays may occur if:

Client feedback is not provided promptly.

Materials (images, text, or branding assets) are not submitted on time.

Requested changes exceed the agreed number of revision rounds.

Envictus is committed to meeting deadlines; however, client cooperation is essential to maintaining the project schedule.

7. Intellectual Property Rights

Upon receipt of final payment, ownership of the completed website design and deliverables will be transferred to you. Envictus retains the right to display completed projects in our portfolio and marketing materials unless otherwise agreed in writing.

8. Confidentiality

Envictus values the confidentiality of all client information.

We will not disclose, share, or distribute any proprietary or sensitive information provided to us during the course of the project, except where disclosure is required by law. Confidential information may include but is not limited to: business plans, marketing strategies, client lists, and financial details.

Similarly, clients agree not to disclose Envictus’ proprietary methods, design processes, or internal documentation to third parties. Mutual confidentiality ensures that both Envictus and our clients are protected throughout and after the duration of the project.

This obligation of confidentiality will survive termination or completion of the project.

9. Termination

Either party may terminate this Agreement with written notice. If the client terminates:

Deposits will not be refunded, as they cover work completed during discovery, mockups, and prototyping.

Clients may retain any deliverables created up to the point of termination.

If Envictus terminates the agreement without cause, the client will be refunded any unused portion of payments for work not yet completed.

10. Indemnification

Clients are solely responsible for all content, images, and materials provided for their website. By engaging our services, you agree to indemnify and hold harmless Envictus Digital Landscaping from any claims, damages, or expenses (including legal fees) arising from:

Content provided by the client that infringes on third-party rights.

Misuse of the website or violation of laws by the client.

Any disputes or claims related to client-provided materials or information.

This protection ensures that Envictus is not held liable for issues outside of our control.

11. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of the state in which Envictus operates, without regard to its conflict of law provisions.

By engaging Envictus Digital Landscaping, you acknowledge that you have read, understood, and agreed to these Terms and Conditions.
